Terms of Sale

1. Purpose

These Terms of Sale define the conditions for the sale of pharmacogenomic analysis packs offered by Olam Création (sole proprietorship / micro-enterprise), founded by Jonas Nephtali, based in France.

2. Products & Pricing

PepFold offers the following analysis packs:

Prices are in euros, all taxes included. As a micro-enterprise, Olam Création is exempt from VAT pursuant to Article 293 B of the French General Tax Code (“VAT not applicable, Art. 293 B CGI”).

3. Payment

Payment is made online by credit card through the secure payment platform Stripe (Stripe Payments Europe, Ltd., 1 Grand Canal Street Lower, Dublin 2, Ireland). Payment is due immediately upon order.

Olam Création does not store any credit card data. All transactions are processed by Stripe in compliance with PCI-DSS standards.

4. Delivery

After payment, the user immediately receives their API key by email (or additional credits are added to their existing key). Access to the service is instant upon receipt of the API key.

5. Right of Withdrawal

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to contracts for the supply of digital content not provided on a tangible medium whose performance has begun with the consumer's prior express consent and express waiver of the right of withdrawal.

By completing the purchase, the user acknowledges that the provision of the API key and access to the service constitutes the beginning of contract performance and expressly waives their right of withdrawal.

6. Warranties

Olam Création undertakes to provide a service consistent with the description published on the site. In case of a technical failure preventing the completion of an analysis, the corresponding credit will be restored to the user's account.

As PepFold is a research tool, no warranty is given as to the suitability of results for therapeutic or medical use.

Olam Création commits to responding within 5 business days.

8. Mediation

In accordance with Articles L611-1 et seq. of the French Consumer Code, in the event of an unresolved dispute, the consumer may use a consumer mediator free of charge. Olam Création will provide the contact details of the competent mediator upon request.

9. Governing Law & Jurisdiction

These Terms of Sale are governed by French law. In the event of a dispute, and after an attempt at amicable resolution, the competent courts of Toulouse, France shall have exclusive jurisdiction.
